I'm not a big fan of legal shit but this out of pocket hospital trip is fully on my Primary Doc and her stupid ass "mistake."

I'm going to talk with a friend's classmate who does medical law and go from there. The thing is I can probably only cover hospital costs because it's the only provable damage.
 
Back out of the hospital now. Meds are fixed and I didn't die lol.

Get the lawyer. Find a good head hunter that gets 33% if he/she wins but 0 if they lose. If the Drs told you to get a lawyer, they'll support the lawsuit. That's not normal. Why would doctors support a lawsuit against other doctors? I mean the money doesn't come out of their pocket, they have malpractice insurance for a reason. But why support a lawsuit that is likely to raise your insurance rates? Think about it.

I was never a fan of lawsuits until my wife could have died from getting rear ended. Think about what could have been. Ask your wife what went through her mind. Pain and suffering doesn't just pertain to you. Your wife should be listed as a plaintiff on the lawsuit simply because of the stress put on her. She didn't deserve that.

Oh yeah. I am not very fond of the legal crap either. But, seems you have a legit gripe.

If you go the "lawyer gets paid if he/she wins" route, discuss an expected timeline. It won't be set in stone, but with no money upfront, such an attorney will put most energy toward the easy money. If that is not you, expect a backburner approach, if there are several cases in the works. Set an expected timeline of progress in advance. If there is no progress in a timely manner, you have a leg to stand on if you need to find another attorney (and get your evidence, affidavits, etc. back), or to make a complaint to the Bar. If needed, giving a 10 business days ultimatum, in writing, to see notable progress, is not unfair. If not satisfied, show ultimatum and response to the Bar.

This. Talk to the lawyer face to face to get an idea if you have a good case. If you want to get his or her full attention, follow up the next day with a written synopsis accompanied with cover letter beginning with "Per our conversation yesterday, enclosed, please find my check for $1000.00 to retain your services. You'll get your $1000.00 back in the lawsuit as "reasonable attorney's fee". Works like a charm every time...

My brother is a lawyer and our dad was in the hospital and suffered some malpractice, he looked into a lawsuit and was told to get a lawyer from out of town, cause those professional types tend to stick together when they know each other,,
